1. Agreement
These terms are between you (and the organization you represent) and Habib Capital LLC, a Florida limited liability company doing business as Habib Capital Social ("we", "us"). By creating an account or using Habib Capital Social at https://social.habibcap.com (the "Service") you agree to these terms and to our Privacy Policy at https://habibcap.com/privacy.
2. The Service
The Service lets you connect social media accounts that you are allowed to manage, then compose, schedule and publish posts and view basic analytics. We are not affiliated with or endorsed by Meta, TikTok, LinkedIn, Google, YouTube, X or Pinterest. Their names belong to their owners.
3. Accounts
You must be 18 or older and able to form a binding contract. Keep your login secure and tell us at admin@habibcap.com if you think it was misused. You are responsible for activity under your account and for the people you invite to your workspace.
4. Connecting social accounts
You may connect only accounts and Pages you own or are authorized to manage. When you connect an account you authorize us to act on your behalf for the permissions shown on the platform's consent screen, which are limited to scheduling, publishing and reporting. You can disconnect at any time inside the Service or from the platform's settings. You must follow each platform's terms and policies. A platform can change or end its access, and we are not liable for that.
5. Your content
You keep ownership of your content. You give us a limited license to store, process and transmit it only to operate the Service for you, including sending it to the platforms you choose. You promise you have the rights to post it and that it does not break the law or platform rules. We may remove content or suspend accounts that violate these terms or platform rules.
6. Acceptable use
Do not use the Service to: send spam; post illegal, deceptive, hateful or infringing content; buy or sell fake engagement; bypass platform limits or review rules; scrape data; attempt to access other customers' data; or interfere with the Service.
7. Fees
If the Service is paid, the price, billing period and renewal terms are shown at signup. Fees are non refundable except where the law requires.
8. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted service. Scheduled posts depend on the connected platform being available and on your token staying valid. You should check that important posts went out. We may change or discontinue features with reasonable notice.
9. Termination
You may close your account at any time. We may suspend or end your access if you break these terms or if a platform requires it. On closure we handle your data as described in the Privacy Policy and https://habibcap.com/data-deletion.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent allowed by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
11. Limit of liability
To the extent allowed by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages, lost profits, or lost data.
12. Indemnity
You will cover losses arising from your content or your breach of these terms or of a platform's rules.
13. Governing law
These terms are governed by the laws of Florida. Disputes will be handled in the courts of Miami-Dade County, Florida.
14. Changes and contact
We may update these terms and will post the new version with a new effective date. Continued use means acceptance.
